NORMATIVE

1. GENERAL RULES
The installation’s schedule is from Monday to Friday from 7am to 11pm, Saturdays from 8am to 8pm, and Sundays and holidays from 9am to 2pm.
It is strictly forbidden to smoke in any part of the installation, including the solarium and vending areas.
No animal is allowed to enter the enclosure with the exception of guide dogs.
A member’s ID is personal and untransferable. The loan of this ID to another person will result in termination of membership.

Members less than fourteen years of age must be accompanied by an adult in order to use the facilities, except when these members participate in an activity specifically directed towards this age range.

It is mandatory to respect the established schedule for each activity. Duet Sports reserves the right to modify the activities’ program, number of sessions, content and schedule.
Swimming lessons take place according to a trimester system, coinciding with the school calendar but with the exception of summer lessons.
Duet Spa does not take responsibility for lost and/or forgotten items. Lost items that have been found will remain at the reception desk for one week. Once this amount of time has concluded, the center cannot be held accountable for the items.
Damaged facilities/materials caused by inadequate use must be replaced and could result in the loss of membership rights.
There are suggestion/complaint sheets available for every user at the customer’s service center.
Each client’s use of the athletic areas or services shall be governed by the characteristics of his or her membership or quota. Otherwise, membership could be abolished.
The monthly cost of membership is calculated including the variability of the venues and activities during summer periods or during periods of technical difficulties.
Failure to comply with any of the requisites stated in this list of regulations could result in temporary or permanent suspension of the right to enter the sports center.

2. ADMINISTRATIVE TRANSACTIONS
At the moment of enrollment, the user must provide a photocopy of his or her ID as well as his or her bank account information in order to receive debit receipts.
The initial membership fee as well as the first month’s fee shall be paid at the reception for processing. The following payments will be sent to the bank entity provided by the user.
The user may make changes to his or her membership or to his or her personal or financial information as long as they make notice of this before the 20th day of the current month.
Likewise, when a user wishes to permanently terminate membership, he or she must notify the reception in written form before the 20th day of the current month.. In this case, in order to request membership again at a later time, the initial enrollment fee shall be charged again.
In the case of there being a return receipt for any reason outside of the organization, administrative costs are borne by the user.
Unpaid bills carry a subcharge of 3 € for their new administrative procedures.
Temporary membership annulments will only be granted due to medical and/or rightly justified reasons. These will remain valid for minimum one month and maximum three months, at which point the user must decide whether to install permanent membership annulment or continue as an active member.

The prices of each service shall be revised and actualized periodically.

 Duet Sports Portitxol reserves the right to apply promotions or enrollment discounts to people who have less than 6 months left of the installation.


3. CHANGING ROOMS
Please respect other users’ space.
Eating or smoking inside the changing rooms is strictly prohibited.
Children under five years of age may enter the changing room applicable to his or her mother or father. From this age forward, children are only allowed in the changing room applicable to their gender.
Bathroom slippers must be worn within the changing room areas.
The center shall not be held responsible for any lost items.
 

For this reason, it is recommended to not take any valuable objects to the center.

All members may temporarily use the lockers equipped with locks. Locks can be purchased within the center itself.

Lockers must be emptied upon the termination of activities.

At the end of the day, all lockers will be opened and the objects located in them extracted. These will be placed in the lost and found for the duration of one week. The money will not be returned due to the management’s expense.

If the key is lost and/or damaged, it must be paid for (3 €).

In order to prevent wasting water, showers must only last the amount of time that is strictly necessary. Contribution to water-saving is imperative.
Users must dry off in the shower area

Duet Sports Portitxol reserves the right to apply promotions or enrollment discounts to people who have less than 6 months left of the installation. 


4. FITNESS ROOM

Children under sixteen years of age are not allowed inside the fitness room nor make use of its equipment.
Users may not enter the fitness room with sports bags, food, glass containers, or other materials that personnel deems inappropriate.
Athletic clothing, appropriate footwear, and shirts must be worn at all times. Only authorized personnel are an exception.
For hygiene reasons, towels must be used at all times when using equipment.
During hours of high activity, cardiovascular machines may only be used for a maximum of twenty minutes.
All materials must be returned to their original location once they are no longer in use.
During breaks in between repetitions, the fitness equipment must be handed over to the following user if he or she is waiting to use it.
Members with individual training plans must put their file away once they have finished using it. Taking training plans outside of the sports center is forbidden.
If a user does not feel well, this must be given the necessary importance and a member of the staff must be informed immediately.
Hydrate (drink water): before, during, and after physical activity. Your body will thank you for it.
If you suffer from a cardiovascular, respiratory, nervous, osteo-articular, or other kind of disease that may result as a health risk, you must inform gym personnel and always be accompanied by another person.

5. GUIDED ACTIVITIES ROOM
Children under sixteen years of age may not participate in guided activities nor enter the guided activities room unless the programmed activities specifically target that age group.
Athletic clothing, shirts, appropriate footwear, and towels must be used at all times.

Guided activities will take place all-year round, with the exception of the month of August and holidays.
The use of towels is mandatory in order to place them on top of the mats and dry off any traces of transpiration that may be left behind.
All materials must be returned to their original location once they are done being used.
Punctuality is essential. You may not join an activity once the warmup has been completed (approximately ten minutes after it begins).

If a user does not feel well, this must be given the necessary importance and a member of the staff must be informed immediately.
Some activities have a limited capacity. Users should get acquainted with the process of reserving spots.

Hydrate (drink water): before, during, and after physical activity. Your body will thank you for it.
If you suffer from a cardiovascular, respiratory, nervous, osteo-articular, or other kind of disease that may result as a health risk, you must inform gym personnel and always be accompanied by another person.

6. CYCLING ROOM
Children under sixteen years of age may not participate in nor enter the cycling room.
Eating and smoking are not allowed. Glass containers and sports bags may not be brought into the cycling room.
Bicycles must be placed in their correct location before and after they are used.
The use of athletic footwear is mandatory. If it is not specific footwear, make sure the shoelaces are drawn back in order to prevent accidents.
The use of towels to wipe off sweat and clean bicycles after use is mandatory.
In order to prevent injuries, do not enter a class if the warmup has already been completed (approximately ten minutes after it begins).
If you feel fatigued or dizzy, do not hesitate to reduce the intensity or end your workout, and inform the trainer at hand.

Hydrate (drink water): before, during, and after physical activity. Your body will thank you for it.
If you suffer from a cardiovascular, respiratory, nervous, osteo-articular, or other kind of disease that may result as a health risk, you must inform gym personnel and always be accompanied by another person.
Since the bicycle room has a limited capacity, get informed on the reservation system at reception.


7. INDOOR POOL
Children under fourteen years of age must be accompanied at all times by an adult over eighteen years of age.
Slippers must be worn while moving around the pool area and showering before entering the water.

Eating and smoking are not allowed. Glass containers and sports bags may not be brought into the pool area.
The use of swimming caps is mandatory. Men must wear one-piece bathing suits and women must wear either one-piece of two-piece bathing suits.
Inside the pool area, both in and out of the water, all risky activities such as running, jumping, pushing, sinking, or playing dangerous games are prohibited.
Please respect the swimming areas / lanes designated for lessons and other activities.

If a user does not feel well, this must be given the necessary importance and a member of the staff must be informed immediately.
If you suffer from a cardiovascular, respiratory, or other kind of disease with an epileptic character, you must inform personnel and always be accompanied by another person.
Do not bathe in the swimming pool if you suffer from any kind of skin disease that can be transmitted through water.
If you suffer from a cardiovascular or respiratory disease or are pregnant, consult a doctor or specialist.


8. SOLARIUM
The opening hours for the solarium will be the following: weekdays and Saturdays from 10:00 am to 19:00 pm and Sundays from 10:00 am to 13:30 pm.
The solarium may only be accessed through the areas designated for this purpose.
Eating, smoking, and entering with glass containers or bottles are not allowed.
Children under fourteen years of age must be accompanied by an adult over eighteen years of age at all times.
Casual clothing and shoes may not be worn inside the solarium. You must wear bathing suits and slippers for moving around the solarium area.
You must respect the areas designated for lessons or other guided activities.
Avoid entering with valuable objects. The sports center will not be held responsible for any lost or stolen items.
The use of music-playing devices as well as any type of medium that allows the recording of images is not allowed.
In order to not disturb other users, playing with balls, shovels, or other playful items is not allowed.
All risky activities such as running, jumping, pushing, sinking, or playing dangerous games are prohibited.
You must wash your feet and sandals before entering the pool area.
The use of any kind of soap in the showers is not allowed.
You must always listen to the orders given by the lifeguard or safety personnel at hand.
The use of umbrellas, chairs, or anything similar is not allowed, with the exception of the hammocks designated for this area.
The hammocks may only be used in their designated area and they may not be reserved or moved around.
The use of sun protection is recommended.
An appropriate amount of exposure to the sun is recommended.

9. TERMARIUM / WHIRLPOOL
Children under sixteen years of age are not allowed.
People who suffer from hypertension (low blood pressure) or serious heart disease may not use these services. If you are unsure, consult a doctor.
Showering before entering the Whirlpool, sauna, or steam room and wearing a swimming cap are mandatory.
Staying for more than 10-15 minutes is not recommended.
You must remove all items that may oppress your skin (watches, necklaces, earrings, etc.).
Each of the pieces of equipment has its adequate method of use that must be followed.
If you feel fatigued or dizzy, do not hesitate to inform the staff member on duty.

10. PADDLE
Courts must be reserved before use. Information regarding the reservation system can be found at the front desk.

Reservations can be made up to a week in advance. In order to formalize a reservation, a phone number, full name, and membership number must be provided.
Paddle courts can only be reserved by members over sixteen years of age, or minors accompanied by an adult (over eighteen).
Reservations must be confirmed at the front desk before beginning a match.
Entering with casual clothing is not allowed. Appropriate paddle footwear must be worn at all times.

If artificial light is needed in the paddle courts, players must pay for their consumption of electric lighting beginning the moment they start playing.
If a member does not show up for a set reservation without informing the front desk, he or she will be charged with the rent of the court.
You must be punctual when it comes to completion of designated court time in order to not bother other users.

11. RENTAL LOCKERS
Only gym members may use this service.
Lockers can be rented at the customer service desk.
By signing this form, you are indicating that you accept the regulations stated on it.
Rents last one trimester and are renewed automatically.
Payments will be made through the bank. If you wish to terminate the service, you must inform customer service before the 20th day of the month in which the trimester ends.
The price of the trimestral rental will be ___ euros.
If, for any reason, you wish to cancel the service before the paid term has ended, the difference will not be refunded.
The user is solely responsible for the fence and the condition of the locker. Any loss or damage shall be the responsibility of the user.
If the user does not remember his or her password and requests for the locker to be opened, the opening of the locker will be charged.
For hygienic and sanitary reasons, leaving wet or humid clothing or materials inside the lockers is not allowed.
During the first week of each new trimester, you will be informed of the locker disinfection date so that you can leave it open that day.
The sports center has the right to vary these regulations in order to benefit the correct use of the service.

 

 

DISCIPLINARY MEASURES
Sport centers are considered public spaces, therefore, certain norms of conduct must be established and regulated through disciplinary measures. This document of disciplinary measures is of great utility when it comes to determining the consequences of an infringement committed by a user.
1. INFRINGEMENTS
Infringements of the code of conduct will be divided into three categories: VERY SERIOUS, SERIOUS, and MINOR.
VERY SERIOUS infringements:
a) The inadequate use of the athletic facilities or equipment, causing a relevant disruption in the tranquility and wellbeing of the other users and their exercise routines.
b) Preventing other users from using any of the athletic facilities or equipment.
c) Preventing or seriously impeding the normal function of the sports center.
d) Serious detriment of equipment, infrastructure, facilities, or materials belonging to the sports center.
e) Physical or verbal aggression towards the personnel or other users.
f) Disobedience of employee’s orders when regarding other users’ safety.
g) Consciously entering areas designated for the opposite sex.
h) Any kind of sexual practices within the sports center.
i) Any theft or attempt at one of an item belonging to the facility or another user.
j) The forgery or misuse of identification documents.
k) Public or notary exposure of falsehoods discrediting the entity or its users.
l) Entering with or exhibiting signs, symbols, emblems, or slogans that, due to their content or the context in which they are displayed, may be considered an act that promotes violence, racism, etc.
m) Entering with weapons, firecrackers, flares, or any other flammable or corrosive products.
n) Lighting fires.
o) The recurrence of serious offences.
SERIOUS infringements:
a) The inadequate use of the athletic facilities or equipment when the circumstances cannot be classified as “very serious”.
b) Detriment of equipment, infrastructure, facilities, or materials belonging to the sports center when it cannot be considered “very serious”.

c) Not respecting the opening hours of the sports center.
d) Not complying with the regulations regarding consumption of tobacco, alcohol, and other narcotic substances.
e) Using the athletic equipment while having in your possession items made of glass, metal, or other substances besides paper and plastic.
f) Entering with animals in any case other than those legally approved.
g) Entering with any kind of vehicle unless authorized to do so during a designated time frame.
h) Teaching classes without authorization.
i) Carrying out any kind of gainful economic activity.
j) Playing games in a non-authorized area.
k) Putting objects inside the water, except when given special authorization.
l) Carrying out photographic or video records without specific permission.
m) Sublet, transfer, or lend the right to use the facilities to a non-member without specific permission.
n) Recurrence of minor infringements.
MINOR infringements:
a) Using the athletic facilities without appropriate clothing.
b) Failing to respect the rules designated for each area.
c) Using music players without headphones.
d) Throwing waste and other substances outside the containers for this purpose.
e) Eating outside of the areas designated for such.

f) Not paying attention to the instructions given by personnel.
g) Any other infringement to the presented regulations that cannot be considered “serious” or “very serious”.

2. PENALTIES
The corresponding penalty when committing an infringement that can be considered VERY SERIOUS will be the suspension of membership rights for a period of one year and possibly permanent suspension.
The corresponding penalty when committing an infringement that can be considered SERIOUS will be the suspension of membership rights for a period between one month and one year.
The corresponding penalty when committing an infringement that can be considered MINOR will be verbal or written reprimand with a possible suspension of membership rights for a period between one day and one month.
3. REPLACEMENT AND INDEMNITY

Regardless of the penalties imposed by the facts established in this document of regulations, the offender is obliged to return all damaged property to its former state, with compensation for damages.
4. RESPONSIBLES
h) Those who commit breaches to these regulations will be held responsible for them.
i) When an infringement is committed by a group of people and the degree of participation of each of them cannot be determined, they will all be held accountable on an individual level and the usual penalties will apply.
5. PROCEDURE
Once an infringement is committed, the following course of action will take place:
j) The Administration of the Sports Center will provide a document stating the center’s regulations and the penalties correspondent to each infringement of those regulations. Until a decision is reached regarding the appropriate penalty, the user may keep using the facilities unless his or her infringement was considered serious or very serious.

k) Users may submit written complaints and present the evidence that he or she believes to defend his or her rights. He or she has ten days from the moment they are accused.
l) Once the previous procedure has been completed by the administration, the user will be notified of the reached agreement within a period of twenty days.
m) Infringements that are considered very serious will be reported to the athletic facility of the municipality when dealing with a public sports center.

 

USE OF INVITATIONS
The Duet Sports centers may provide invitations to members and non-members with the purpose of facilitating access to the sports center. In order to make use of these invitations, the following requisites must be met:

·                              - Each Duet Sports installation will decide the motive of an invitation with reference to its own commercial policy. These motives do not need to necessarily be indefinite in time.

·                              - Each user is limited to two invitations a year. This period will be counted beginning with the use of the first invitation so that from that moment on, no more than one more invitation may be provided within the next year.

·                              - Invitations may not be used by ex-members who have not been members for over a year or have any pending debts.

·                              - The use of an invitation allows the recipient to enter the sports center for one day and have access to de same services and privileges that a normal member has. However, in no case will an invitation include services such as classes, personal training, esthetic services, Health services, etc.

·                              - Using an invitation involves allowing the processing of the user’s personal data.

·                              - With the use of an invitation, the recipient agrees to being aware of the implied risks that physical exercise can have on his or her health. The enterprise shall not be held responsible for any injuries.

·                              - The administration of each Duet Sports center may modify this policy in order to benefit the commodity of its users.
